Terms of Use

The agreement between you and us for using the gethome website, the app for iPhone, gethome hub and gethome studio. By using any of them, you agree to these terms. 1. Who we are and what these cover

The website at gethome.me, the gethome app for iPhone and its widgets (“the app”), gethome hub (“the hub”) and gethome studio for Mac (“Studio”) — together, “gethome” — are made by Georgy Galanin, an independent developer (“we”, “us”).

By using gethome you agree to these terms and to our Privacy Policy, which explains what happens to your information. If you don’t agree, please don’t use it.

2. Who can use gethome

You must be at least 13 years old and old enough to agree to these terms where you live — or have a parent or guardian agree to them for you. If you use gethome for an organization, you confirm that you’re allowed to accept these terms on its behalf.

3. What it costs

Everything described here is currently free. If we ever charge for a feature, you’ll see the price and the terms before you pay, and nothing will cost you money without you choosing it.

AI features run on an API key from OpenAI or Anthropic. The provider charges the key’s owner for what the key is used for, under its own terms. Those charges are between the key’s owner and the provider, and we can’t refund them.

4. Using the apps

We give you a personal, non-exclusive, non-transferable, revocable license to install and use the app and Studio on devices you own or control, for as long as you follow these terms. You may not sell, rent or redistribute them, or copy, modify or reverse engineer them except where the law allows it despite this restriction.

5. The App Store

If you got the app from Apple’s App Store, Apple’s Licensed Application End User License Agreement (the “Standard EULA”) also applies to it, and where the Standard EULA and these terms disagree about the app, the Standard EULA wins. You and we also acknowledge that:

  • these terms are between you and us, not Apple, and we — not Apple — are solely responsible for the app and its content;
  • Apple has no obligation to provide any maintenance or support for the app;
  • if the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any; to the maximum extent the law allows, Apple has no other warranty obligation for the app;
  • Apple is not responsible for addressing any claims by you or anyone else relating to the app or your possession or use of it, including product liability claims, claims that it fails to conform to any legal or regulatory requirement, and claims under consumer protection, privacy or similar laws;
  • if anyone claims that the app or your possession or use of it infringes their intellectual property rights, we, not Apple, are solely responsible for investigating, defending, settling and discharging that claim;
  • you represent that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties;
  • you must comply with the terms of any third party whose service you use with the app, such as your wireless carrier;
  • Apple and its subsidiaries are third-party beneficiaries of these terms, and once you accept them, Apple has the right to enforce them against you as a third-party beneficiary.

6. The hub’s license

The hub is source-available. Its code — including its installer and the builds we publish — is licensed under the PolyForm Noncommercial License 1.0.0, which lets you use, change and share it for any noncommercial purpose: your own home, hobby projects, research, education or a charity. Commercial use, such as in hotels, rentals, property management, paid installations or a product you sell, needs a separate commercial license.

That license decides what you may do with the hub’s code. These terms add to it for everything else, such as the website and the apps, and where the two disagree about the hub’s code, the license wins.

7. Your home and your network

You are responsible for:

  • the devices, accessories and network you use with gethome, and for keeping them — and the computer the hub runs on — secure and up to date;
  • who you invite into a home and the roles you give them, since every member can work its devices;
  • using cameras, microphones, sensors and locks lawfully — including telling the people who live with you, guests and neighbors when and how they may be recorded or monitored, and getting their consent where the law requires it;
  • keeping your API keys, pairing codes and sign-in codes to yourself;
  • backing up anything you can’t afford to lose.

8. Not a safety system

Please don’t rely on gethome for anything where a failure could hurt someone or cause serious loss. Automations, AI agents, networks, devices and the hub itself can fail, lag or behave unexpectedly, and the app can show a state that is out of date. In particular:

  • it isn’t a replacement for smoke, carbon monoxide, leak or intrusion alarms, a monitored security service, or medical devices — keep the ones certified for those jobs;
  • don’t use it to call for help, and don’t count on it to tell you about an emergency;
  • make sure locks, doors, heating and anything else that matters can still be worked by hand, and check what an automation will do before you let it act on them.

9. AI features

AI features are optional. When you use them:

  • what you send goes to OpenAI or Anthropic as the Privacy Policy describes, under the account of whoever owns the key, and you must follow that provider’s terms and usage policies (OpenAI, Anthropic);
  • AI output can be wrong, incomplete or surprising: a device can be recognized incorrectly, an answer can be mistaken, and an automation an agent writes may not do what you meant;
  • the assistant and the agents can work your devices and change your automations when asked, so check what they propose before you rely on it;
  • you’re responsible for what you ask for, and for how you use the results.

10. Setting up a hub with Studio

Studio installs software on a Raspberry Pi and changes its configuration so the hub can run there. To do that, it may:

  • write to an SD card you choose — so check you’ve picked the right one, because files on it can be changed or lost;
  • connect to your Raspberry Pi over SSH, install the hub and the software it depends on, and set it to start by itself;
  • add its own SSH key to the Raspberry Pi and let the Pi’s user run administrative commands without a password, so it can install and update the hub later;
  • set up the Raspberry Pi’s Wi-Fi with the details you enter.

Only use Studio on hardware you own or are allowed to change, and back up anything on it first.

11. Other companies’ services and software

The products work with services and software that other companies and communities provide — including Apple Home, the App Store, OpenAI, Anthropic, GitHub, Raspberry Pi OS, Zigbee2MQTT, Matter and the open-source components inside each of our products. Their own terms and licenses apply to them. We don’t control them and aren’t responsible for them, for whether they’re available, or for changes they make that affect gethome.

12. Acceptable use

Don’t use gethome to:

  • break the law, or anyone else’s rights, including their privacy;
  • watch, record or track people without the notice and consent the law requires;
  • get into devices, homes, hubs or networks you aren’t allowed to use;
  • interfere with the website or other people’s use of it.

13. Ownership and feedback

We and our licensors own gethome, including its software, its design and the gethome name and logo. These terms don’t give you any right to use our name or logo, and they give you no rights in the hub’s code beyond what its license grants.

Apple, the Apple logo, iPhone, Mac, macOS and HomeKit are trademarks of Apple Inc., registered in the U.S. and other countries and regions. App Store is a service mark of Apple Inc.

Your homes, names, messages and photos stay yours. We claim no rights in them — and, as the Privacy Policy explains, we don’t receive them.

If you send us feedback or ideas, we may use them without owing you anything.

14. Changes and availability

The products are in active development. Features may change, move or be removed; some parts may be offered as previews that don’t always work as intended; and we may stop offering any part of gethome. What you’ve installed keeps working on your own devices as far as it can, but we can’t promise that every version will keep working with every device, with future versions of iOS or macOS, or with other companies’ services.

15. Disclaimer

To the fullest extent the law allows, gethome is provided “as is” and “as available”, without warranties of any kind, express or implied — including warranties of merchantability, fitness for a particular purpose, title and non-infringement, and any warranty that it will be uninterrupted, secure, accurate or free of errors, or that it will work with any particular device.

Some places don’t allow these exclusions, so some of them may not apply to you.

16. Limitation of liability

To the fullest extent the law allows, we won’t be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or property, arising from your use of gethome — including devices, automations or AI features acting or failing to act — even if we were told such damages were possible. Our total liability for all claims relating to gethome is limited to the greater of US$50 and what you paid us for gethome in the 12 months before the claim.

Nothing in these terms limits liability that the law doesn’t allow to be limited — such as for fraud, or for death or personal injury caused by negligence — or takes away rights you have as a consumer under the law where you live.

17. Indemnity

To the extent the law allows, you agree to cover our losses and costs, including reasonable legal fees, from claims by others that arise from your breaking these terms or misusing gethome — for example, recording people unlawfully.

18. Ending

You can stop using gethome at any time. We may suspend or end your access to anything we provide online, such as the website, if you seriously or repeatedly break these terms. The sections that by their nature should outlast the end of these terms — including ownership, the disclaimer, limitation of liability, indemnity and governing law — do.

19. Governing law and disputes

These terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law rules. If a dispute comes up, please write to us first — most things can be sorted out that way — and give us 30 days to try before you start a legal claim. Any claim must be brought in the state or federal courts located in Delaware, and you and we consent to their jurisdiction.

If you are a consumer living outside the United States, you also keep the protection of the mandatory laws of the country you live in, and you may bring a claim in its courts.

20. General

These terms, together with the Privacy Policy and — for the hub’s code — its license, are the whole agreement between you and us about gethome. If any part of them can’t be enforced, the rest still applies. If we don’t enforce a term straight away, we haven’t given it up. You may not transfer your rights under these terms; we may transfer ours to someone who takes gethome over. Apart from Apple, as described above, no one else has rights under these terms.

21. Changes to these terms

We may update these terms. We’ll change the date at the top, and for significant changes we’ll say so on the website or in the apps before they take effect. If you keep using gethome after that, you accept the updated terms.
